2. Collection and storage of personal data and the nature and purpose of its use

a) When visiting the website

When you visit our website www.niehaus-recht.com, the browser used on your device automatically sends information to our website's server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until it is automatically deleted::

  • IP address of the requesting computer,

  • date and time of access,

  • name and URL of the file accessed,

  • website from which access is made (referrer URL),

  • browser used and, if applicable, the operating system of your computer and the name of your access provider.

 

b) When using our contact form

 

If you have any questions, you can contact us using the form provided on the website. You will need to provide your first name, last name, and a valid email address so that we know who the inquiry is from and can respond to it. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) (a) GDPR on the basis of your voluntary consent.

The personal data collected by us for the use of the contact form will be automatically deleted after your request has been processed.

We process the aforementioned data for the following purposes:

  • Ensuring smooth connection to the website,

  • Ensuring comfortable use of our website,

  • Evaluating system security and stability, and

  • For other administrative purposes.

 

The legal basis for data processing is Art. 6 (1) (f) GDPR. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.

3. Data transfer

Your personal data will not be transferred to third parties for purposes other than those listed below.

 

We will only pass on your personal data to third parties if:

  • You have given your express consent to this in accordance with Art. 6 (1) (a) GDPR

  • the transfer is necessary for the establishment, exercise, or defense of legal claims pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,

  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and

  • this is legally permissible and necessary for the performance of contractual relationships with you pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR.

 

4. Rights of affected persons

 

You have the right:

  • pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if it was not collected by us, and the existence of automated decision-making, including profiling and, if applicable, meaningful information about its details;

  • to request the immediate correction of inaccurate or incomplete personal data stored by us in accordance with Art. 16 GDPR;

  • pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;

  • pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful but you oppose its erasure and we no longer need the data, but you need it for the establishment, exercise, or defense of legal claims, or you have objected to the processing pursuant to Art. 21 GDPR;

  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request its transfer to another controller;

  • pursuant to Art. 7 (3) GDPR, to revoke your consent at any time. As a result, we will no longer be permitted to continue processing data based on this consent in the future, and

  • to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

5. Right to object

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) (f) GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object, which we will implement without you having to specify a particular situation.

6. Data security

 

When you visit our website, we use the widely used SSL (Secure Socket Layer) procedure in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead.

We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

 

7. Photos of employees

 

We would like to point out that the photos of our employees are legally protected in accordance with § 22 KUG (right to one's own image). In particular, downloading, manipulation, publication, or reproduction of the images is not permitted. Any violation of the right to one's own image may result in claims for injunctive relief or damages.

This privacy policy is currently valid and was last updated in December 2025.

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
